These Terms govern your use of Speeks — a community service for dropping files ("Speeks") at real-world locations to be found through SPECS AR glasses. By creating an account or using Speeks, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Speeks.
You must be at least 13 years old to use Speeks. If you are under the age of majority where you live, you may use Speeks only with a parent or guardian's involvement. By using Speeks you confirm you meet these requirements and that the information you provide is accurate.
You verify your account with your mobile phone number. You're responsible for activity under your account and for keeping access to your phone number secure. Choose a username that isn't misleading or infringing; handles are first-come, first-served and we may reclaim ones that impersonate others or violate these Terms.
You keep ownership of the files and descriptions you drop ("your content"). To run the service, you grant Speeks a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and create previews of your content as needed to operate, promote, and improve Speeks — including generating an obscured "teaser" preview and a shareable image, and showing your username, filename, and drop location publicly on the map.
You represent that you own or have the rights to everything you drop, and that it doesn't infringe anyone's rights or break the law.
Speeks is a shared, public map. Your username, filenames, locations, stats, and content teasers are visible to others. Don't use Speeks to upload, drop, or share anything that:
You're solely responsible for where you drop Speeks and for choosing safe, lawful, publicly accessible locations. Don't place Speeks on private property without permission or anywhere that could put people at risk.
Speeks includes reporting tools. We may review reports and remove content or suspend accounts that violate these Terms, at our discretion. Content that receives multiple valid reports may be removed automatically.
We respect intellectual property rights and respond to valid notices under the Digital Millennium Copyright Act (DMCA). If you believe content on Speeks infringes your copyright, use the in-app "Report → Copyright" flow or email aidan3dbit@gmail.com with: identification of the work, the infringing Speek, your contact information, a good-faith statement, a statement under penalty of perjury that you're authorized to act, and your signature. We may remove infringing content and terminate repeat infringers.
By providing your phone number and consenting, you agree to receive verification text messages from Speeks via Twilio. Message and data rates may apply; frequency varies. Reply STOP to opt out or HELP for help. Opting out may prevent phone-based login.
Some map areas may be reserved (for example, for SPECS early adopters). We may restrict where certain users can drop Speeks, and may add, change, or remove these areas at any time.
Speeks is an independent, community-built project for SPECS enthusiasts. SPECS, Snap, Snapchat, and related names and logos are trademarks of their respective owners. Any reference to them is nominative and does not imply affiliation with or endorsement by their owners unless expressly stated.
Speeks is a preview/community project provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, or that content will be found, preserved, or openable. We may change, suspend, or discontinue any part of Speeks at any time.
To the maximum extent permitted by law, Speeks and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, content, or profits, arising from your use of Speeks. Our total liability for any claim is limited to the greater of the amount you paid us (if any) in the past 12 months or USD $50.
You agree to indemnify and hold harmless Speeks and its operators from claims, damages, and expenses arising out of your content, your use of Speeks, or your violation of these Terms or any law or third-party right.
You can stop using Speeks and request deletion of your account at any time by emailing us. We may suspend or terminate accounts that violate these Terms. Provisions that by their nature should survive termination (e.g. content license for already-public material, disclaimers, and liability limits) will survive.
We may update these Terms as Speeks evolves. We'll update the "last updated" date above, and continued use after changes means you accept the revised Terms.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, and you agree to the exclusive jurisdiction of the state and federal courts located there, except where prohibited by your local law.
